The first teaser trailer was released online in February 2011. The first full trailer was released in April 2011. Later in the same month Warner Bros. pulled the trailer from theaters for violating an MPAA rule stating that films can only trailer before similarly rated movies. The trailer for the R-rated comedy was being promoted at screenings for the PG-13-rated Source Code against MPAA regulations. Warner Bros. released a statement saying, “In our haste to meet the placement schedule for this trailer, we failed to properly vet the final version with the MPAA. We acted immediately to correct the mistake and removed the trailer from screens”.
Warner Bros. asserted about 16 defenses. They acknowledged that the tattoos were similar but denied that theirs was a copy. They further argued that “tattoos on the skin are not copyrightable”. They reasoned that a human body is a useful article under 17 U.S.C. § 101 and thus not copyrightable. The question of a tattoo’s copyrightability had never been determined by the Supreme Court of the United States. Arguments in the alternative included that Tyson, by allowing them to use his likeness and not objecting to the plot device in The Hangover Part II, had given them an implied license, and that their use of the tattoo constituted fair use as parody because it juxtaposed Tyson as “the epitome of male aggression” with the “milquetoast” Price. Scholar David Nimmer, participating an expert witness for Warner Bros., argued that treating tattoos as copyrightable would violate the Thirteenth Amendment to the United States Constitution as a badge of slavery; Nimmer’s declaration was then excluded because it was a legal opinion.
The streaming service Hulu was all set to release the series MIKE on August 25. The platform made the announcement in June and they had cast the Moonlight actor Trevante Rhodes as Mike Tyson. By 2003, Tyson declared bankruptcy despite career earnings in the hundreds of millions. With his boxing career effectively over by 2005, Tyson struggled with drug addiction, suffered through the accidental death of his four-year-old daughter, and had more run-ins with the law. Throughout his career, he often appeared in cameos as himself, including in Sylvester Stallone’s “Rocky Balboa” (2006). His fortunes changed, though, when he received positive reviews for his appearance in the smash comedy “The Hangover” (2009). Playing a fictional version of himself, Tyson was a hit with audiences. He began acting more regularly, including in the sequel “The Hangover Part II,” usually playing some variation of the same fictional alter-ego. He created and voiced the lead character for the sly animated “Mike Tyson Mysteries” (Adult Swim, 2014-18), earning additional accolades. As his acting career continued, he began branching into roles where he was playing a character separate from himself in films like “Kickboxer: Retaliation” (2018) and “The Devil May Care” (2018).
